General Questions

Questions our existing clients often ask us about acquiring British Citizenship for children

Registering a child as a British citizen is a crucial step for parents who want to secure their child’s legal status in the United Kingdom. This process is typically necessary when a child is born to non-British parents in the UK or when they have lived in the UK for a certain period and meet specific eligibility criteria. Registering your child as a British citizen is an essential step in ensuring their rights and opportunities in the UK, and it’s vital to follow the application process carefully to meet all the requirements.

Children are entitled to registration under section 1(3) of the British Nationality Act 1981 if:

  • they were born in the UK
  • they were not British citizens at birth because at the time neither parent was a British citizen or settled
  • while they are minors either of the parents has since become a British citizen or settled in the UK
  • they are under the age of 18 on the date the application is received
  • they are of good character if over the age of 10

Children and adults are entitled to registration under section 1(4) of the British Nationality Act 1981 if:

  • they were born in the UK
  • they were not a British citizen at birth as at the time of birth neither parent was a British citizen or settled in the UK
  • they are aged 10 years or over on the date of the application
  • they have lived in the UK for the first 10 years of their life
  • they have not been outside of the UK for more than 90 days in each of the first 10 years of their life
  • the Secretary of State is satisfied they are of good character

When registering a child as a British Citizen, you typically need to provide specific evidence to support your application. The required documentation can vary depending on the child’s circumstances and eligibility category. Here is a general list of common evidence you may need to provide:

  1. Child’s Birth Certificate: A copy of the child’s birth certificate, which includes details about their birthplace and parents.

  2. Proof of Parentage: Documents such as the parents’ birth certificates, marriage certificates (if applicable), and any legal adoption or guardianship documents.

  3. Passports and Immigration Status: Evidence of the parents’ immigration status in the UK, including passports, visas, or residence permits.

  4. Proof of Residence: Documents that demonstrate the child’s residence in the UK. This can include tenancy agreements, utility bills, school records, or medical records.

  5. Character References: Sometimes, particularly if your child is over 10 years old, you may need to provide character references from individuals who can vouch for your child’s good character and their commitment to the UK.

  6. Fee Payment: Payment confirmation for the application fee, which can vary depending on the type of application and the child’s age.

  7. Supporting Letters: Any additional supporting letters or documents that can strengthen your case, such as proof of the child’s integration into British society or evidence of exceptional circumstances.

The application fee for registering your child as a British Citizen is currently £1012 per child. There may be additional costs related to translation and Home Office fees. Your lawyer will advise you of the total anticipated costs at the outset of our work with you, so you can ensure you have the funds available at the point of submitting your application.

The processing time for registering your child as a British Citizen can vary. However, it typically takes around 8 – 12 weeks from the date you submit your application. Please note that processing times can be longer during peak periods or if additional documentation is required.

We offer a comprehensive range of services to assist with your child’s British Citizenship application. This includes a free initial consultation, detailed advice from your personal immigration lawyer, evidence checklist and document collection, application preparation and submission, handling interactions with immigration authorities, and guidance on the Citizenship decision and next steps.
